He also stated: "Sai owns the boat, but was not the boat operator. This is a cover up. . . . . All the locals in this video describing the aggressive driver and the numerous run ins are all referring to Siddha Bellord, not Sai Hansen." A copy of the statement is attached.

In another posting on the same forum, dated April 13, 2016, Mr. Ranson made wide-ranging allegations in which he included the following statements implicating Mr. Bellord:

"Massive cover up, elaborate conspiracy to obscure the truth and feign innocence. Maybe cold blooded, a hit, but could have been an accident they scrambled to cover up, perhaps just to

remove an important person like Siddha Bellord from the scene, Siddha Bellord seems to be at least one of the male voices on this call, and this girl on the phone I do not think is Sai's daughter, I believe the girl on the 9II caIl is Siddha's young daughter Tungi Bellord. A distinctive Bellord accent."

The foregoing statements made by you have no factual basis. The death of Mr. Shim has been the subject of numerous news repofts all of which identified the driver of the boat as Sai Hansen. None of the reports implicated Mr. Bellord in the accident. Similarly, subsequent charges filed in court identify Mr. Hansen as the driver. The defamatory misrepresentation that Mr. Bellord or his daughter were involved in and caused the accident appears to be pure speculation and is denied by Mr. Bellord. Therefore your statements that Mr. Bellord was responsible for or implicated in the death of Mr. Shim are false. Given the complete lack of any objective facts to connect Mr. Bellord to the accident, your statements are a deliberate falsification of facts made in reckless disregard of the truth.

We note that the foregoing similar statements implicating Mr. Bellord in the killing of Mr. Shim have evidently been coordinated or made in collaboration between the two of you acting in concert. All defamatory statements published on the Internet imputing responsibility for Mr. Shim's death to Mr. Bellord appear to have originated from you.

Under the law of Hawaii and other jurisdictions, a false statement tending to harm a person's reputation, so as to lower him in the estimation of the community or deter third persons from associating or dealing with him, that is published negligently, recklessly, or purposefully exposes the author of the statement to liability for defamation. Imputation of a crime is defamatory per se. Your statements considered as a whole clearly convey to the ordinary reader a defamatory meaning, namely, they impute criminal conduct to Mr. Bellord, either expressly or by innuendo. The defamatory imputation may be made by innuendo, by figure of speech, by expression of belief, or by irony or satire.

Therefore, you are liable to Mr. Bellord for your statements falsely accusing or imputing to Mr. Bellord the unlawful killing of Mr. Shim. Moreovet, making defamatory false statements recklessly or puposefully implies malice and a spirit of mischiet or at least willful misconduct raising the presumption of a conscious indifference to the consequences, which additionally
